1. PARTIES AND DEFINITIONS

This agreement is concluded between aeklink Information Technologies Ltd. Co. (hereinafter referred to as "aeklink" or "Company") and natural or legal persons who benefit from the services offered by aeklink (hereinafter referred to as "User" or "Customer").\n\nThe term "Service" refers to web hosting, domain registration, virtual server (VPS), dedicated server and all related information technology services.\n\nThe term "Platform" refers to aeklink's website, management panels and API services.

2. ACCEPTANCE OF AGREEMENT

This agreement becomes effective when the User starts using any of aeklink services. Use of the service means acceptance of this entire agreement.\n\nThe User declares that they are 18 years old and have legal capacity. Natural persons acting on behalf of legal entities declare that they are authorized to perform this transaction.\n\nThe terms of the agreement may be changed by aeklink with prior notice. Changes become effective from the date they are published on the website.

3. SERVICE SCOPE AND CONDITIONS

aeklink provides the following services:\n\n• Web Hosting Services: Shared hosting, VPS hosting, dedicated server services\n• Domain Services: Domain registration, transfer, renewal and DNS management\n• Cloud Computing Services: Virtual servers, backup services\n• Email Services: Professional email accounts and management\n• SSL Certificates: SSL/TLS certificates for website security\n• Technical Support: 24/7 phone, email and live support services\n\nAll services, technical specifications and limitations are detailed on the website and in service agreements.

4. USER OBLIGATIONS

The User accepts the following obligations:\n\n• Ensuring the confidentiality of account information and preventing unauthorized use\n• Using services only for legal purposes\n• Respecting copyright, trademark and other intellectual property rights\n• Not sharing spam, phishing, malware or harmful content\n• Not overusing system resources and not affecting other users\n• Not exploiting security vulnerabilities\n• Not hosting illegal content (hate speech, pornography, gambling, etc.)\n• Fulfilling payment obligations on time\n• Cooperating in case of service interruption\n\nThe User agrees that their account may be suspended or closed in case of violation of the above rules.

5. COMPANY OBLIGATIONS AND GUARANTEES

aeklink provides the following guarantees:\n\n• 99.9% Uptime Guarantee: 99.9% accessibility is targeted on an annual basis\n• 24/7 Technical Support: Uninterrupted support service\n• Data Security: Industry standard security measures\n• Regular Backup: Automatic data backup system\n• Quick Response: Response within 15 minutes in emergencies\n\nThe Company gives 48 hours notice for planned maintenance work. Planned maintenance is not included in the uptime guarantee.\n\nForce majeure situations (natural disasters, terrorism, war, internet infrastructure problems, etc.) are excluded from the guarantee scope.

6. PRICING AND PAYMENT TERMS

Service fees are collected according to the current price list specified on the website. Prices include VAT.\n\nPayment options:\n• Credit card (Visa, Mastercard, American Express)\n• Bank transfer\n• EFT/Wire transfer\n• Cryptocurrency (Bitcoin, Ethereum - for selected services)\n\nInvoices are issued monthly or annually. 15% discount is applied for annual payments.\n\nIn case of payment delay, the service is suspended. If payment is not made for 30 days, the account is closed and data is deleted.\n\nRefund conditions:\n• Hosting services: 100% refund within the first 30 days\n• Domain registrations: Non-refundable\n• Setup fees: Non-refundable\n• Custom services: Varies according to contract

7. LIMITATION OF LIABILITY

aeklink's liability is limited as follows:\n\n• No liability is accepted for indirect damages resulting from service interruption\n• Compensation for data loss cannot exceed the paid service fee\n• No liability is accepted for the User's illegal activities\n• No liability is accepted for problems in third-party services (domain registrar, CDN, etc.)\n• No liability is accepted for force majeure situations\n\nThe User agrees that they use the services at their own responsibility and that the responsibility for backing up critical data is their own.\n\nThe Company's total liability for damages resulting from cyber attacks, hacker intervention or systemic errors is limited to 1 year of service fee.

8. PRIVACY AND DATA PROTECTION

aeklink operates in accordance with the Personal Data Protection Law (KVKK) and GDPR provisions.\n\nData collected:\n• Identity information (name, surname, ID number)\n• Contact information (phone, email, address)\n• Payment information (credit card information is stored encrypted)\n• Technical logs (IP address, access logs)\n• Usage statistics\n\nData is used for the following purposes:\n• Service delivery and billing\n• Providing technical support\n• Fulfilling legal obligations\n• Marketing activities (with explicit consent)\n• Security and audit\n\nData is not shared with third parties except for legal obligations. Users can request deletion of their data at any time.

9. SERVICE TERMINATION

The agreement may be terminated in the following cases:\n\nBy the User:\n• With 30 days written notice\n• With service cancellation form\n• By not making payment (automatic termination)\n\nBy the Company:\n• Immediately in case of contract violation\n• After 30 days in case of payment delay\n• Due to legal obligations\n• In situations that pose a security risk\n\nIn case of termination:\n• Data is kept for 30 days\n• Backup service is provided free for 30 days\n• Domain transfer is facilitated\n• No refund for remaining period\n• Special agreements remain valid

10. DISPUTE RESOLUTION

Disputes arising from this agreement are first attempted to be resolved through amicable negotiations.\n\nIf no solution can be achieved:\n• Istanbul Courts and Enforcement Offices are authorized\n• Turkish Law applies\n• Consumer Arbitration Committees can be applied for consumer disputes\n• Mediation method can be applied\n\nThe agreement is prepared in Turkish, and translation texts are for informational purposes only. In case of dispute, the Turkish text is taken as basis.

11. OTHER PROVISIONS

Even if any article of this agreement is deemed invalid, other articles remain valid.\n\nContract changes can only be made in writing and published on the website.\n\nContact Information:\naeklink Information Technologies Ltd.
